possibly facing repo of car wha can i do

question,this is about reposession of my vehicle. how many payment sbehind can you be before a finace comapny will repo your car. my car is finced thru triad financial in california and i live in NC i amtwo payments behind and was suppose to make one today but don\'t have the money , I will be 3 months behind on 10/6 but i can pay a payment on 10/6. the reprensentative told me my loan wouldbe sold if i didn\'t pay today and that car would be repossessed.what can i do ? I \'ve had car less than a year bought it from southern states buick dodge mazda in raleigh,nc and it \'s been in and out of shop needs power steering pump no wand rear end serviced.had to have brales put on it after having it a month and got no warranty with it as is
I just came out of a bankruptsy and they say I still owe 2000.00 on my vehicle and will not let me make payments. They called today and said they was just going to repo it. I hid the vehicle. I live in North Carolina. Can I get in trouble with the law?

Hi Renee,

If you have included the vehicle in your bankruptcy filing and haven't reaffirmed the mortgage, then the lender can repossess it. However, if you make the payments, then the lender won't repo the property.

Hiding it won't work out too well, will it? You won't be able to drive it, after all, because if they spot you they'll tail you, wait till you park it and then tow it away.

I'd think you might want to speak with your bankruptcy attorney, the trustee and the lender as well, to determine what rights you have in this case.

Hi tiffany,

I don't think the lender will issue any arrest warrant against you. Rather the lender may charge off the loan to a collection agency who can in turn contact you for the debts.
