my husband and i are trying to get out of our house. we are upside down and can no longer afford it. our lender will not help us. we have been talking to their early loss mitigation department but have not gone late on our payments yet in fear of getting bad credit. how do we get their attention enough to have them consider the two above options? who do we speak to about it?

Why do you think that your lender will not help you? Talk to the lender directly and let him know about your problem regarding your mortgage payments? See, no lenders want foreclosure. At the end of the day if the mortgage is foreclosed, no one will be benefited.
If you don't want the house, have you tried to sell it out and pay the lender off? You can do it yourself but just let the lender know about it.

i think it is better to talk to the lender directly. you should state everything clearly to him so that he is able to understand your situation. then he might agree to a mortgage modification or a forbearance.
you may list your house with a real estate agent so that they might help you to sell your house.
even if you want to do a deed in lieu of foreclosure, you have to talk to your lender first. you may do that only if your lender is willing to accept that.

You may want to get an attorney that specializes in foreclosure prevention. He or she may be able to get a hold of the right people with the lender. If you want to handle this yourself, I would suggest calling over and over again and insist on talking with a manager that will be able to get you to the right person that can help you. It might just take a little persistance at this point.
