the quit claim deed was sumbit to county did, nt have my singauter and ther is not one doc with my signanuter. the title company missed all the sign and give they the proceed . the only good thing in this was my mortgage sent the check back what are my legal rights in this matter andwho is at fault here.

i suppose you are the grantor and the quit claim is not valid without the signature of the grantor.

is the grantee willing to refinance the mortgage in his name?

i think there has been some kind of mis-communication between you and the mortgage company if they have sent back the check. because only a quit claim will not release you from the financial obligations and the mortgage is still on your name.

Welcome to this forum.

I have not got your question clearly. What I have understood is you are the granter and there was no signature of the grantor. If so the deed will not be counted as a valid deed. Eugene is right. You can also consult with an attorney regarding this.

Can you please explain it clearly so that we can help you out?
