house title, mortgage and quit deed

I bought a house five years ago, and put my gf's name under the house title, but i am the only person taking under the mortgage, now we split, and i signed the quitdeed form to her since she promised that she will pay me money to take over the house, but she never paid me and she wanted to claimed the house to herself. What shall I do? Can she sell the house and refi the mortgage without my notices?

If she is the sole owner of the property, she has the right to sell off the property without any notice to you. However, if the mortgage still remains in your name, then the lender can come after you for the payments. In such a situation, it will be better if she could refinance the mortgage and release you from the liabilities toward the loan.

r u saying that she can sell the house for the full money and I still need to pay off the mortgage loan?

Yes, you're right! Unfortunately, if the property is in her name solely, then she can sell off the property as and when she feels like. As the lender knows that you are the borrower, the lender will come to you to recover the debt in full.

If she have authority to sell the then she sell the house without giving any notice to you.

I am the only person in the mortgage, and if she sells the house and i defaulted the mortgage payment, there is nothing for lender for the foreclosure even they can come to me for the money, will the lender let that happen?

Welcome to the forums!

As your name is on the mortgage docs, the lender will come after you to recover the payments. He may even charge off the debts and the collection agency can come after you to recover the payments.
