In my divorce I was granted title/deed to my home by the Judge, I am held accountable for any loss or gain on the home. My ex husband is on the mortgage note only and I pay the mortgage note with part of the child support payments. My ex-husband and I have joint custody between the kids, with me being the j.m.c. We are wanting to trade rolls now, he wants to move into my home and pay the mortgage with a signed lease contract on my home and I will be moving into an apartment. We have plans on selling the home in 2 years. The child support would be also be dissovled with no child support between us. We would have joint custody yet he would be the j.m.c. with the kids. My question is can he take any claim on my home w/ him paying the mortgage note instead of me?

Hi lmm,
Unless your husband's name is mentioned on the property deed, he won't be able to get ownership rights on that property though he makes the mortgage payments. If the property is solely in your name, then you will be considered the sole owner of the property.
Thanks

Welcome lmm,
Paying the mortgage won't give your ex-husband any right to the property unless his name is mentioned on the property deed.

Thank you for taking the time into answering my question. Peace be with ya!
You have a document the Judge provided you that spells out everything you and you ex are supposed to do. If you want to revise the situation, you need to visit the Judge again, and request a revision. That'll protect both you and your ex.
