Person was told they needed to sign the mortgage papers but that it would not make them responsible. Now 6 months after the divorce the x has defaulted and the mortgage co. is going after the other. can anything be done?

Are you on the deed and also on the mortgage? If you are on the deed and also on the mortgage and if you do not want to have the property then you can quitclaim the property to your ex but before that ask him to take the mortgage on his name.

If he does not agree with that then you can file a Partition lawsuit against him. Then the house will be sold and the proceeds will be divided accordingly.

I don't believe she is on the deed' just signed the mortgage papers. The x owns a bunch of properties in florida and is defaulting on all of the. the bank is now coming after her. she was told at the signing she would not be responsible. anything she can do? I'm just trying to help. thanks, Karen

Why would the lender come after her if she is not on the mortgage or on the deed? So how does they make her responsible for the mortgage
I think you will better contact with an attorney in this regard.
