4506T

My husband and I signed a 4506T form back in Nov 2011 and on it said 1 year 2010 taxes. We were told our loan would close within the end of the year.
The loan still hasn't closed. And they wanted me to send either an extension or a copy of 2011 taxes, which I didn't. And haven't signed anything. Now they are telling me they pulled a 4506T on us for 2011. Isn't that against the law?

Hi Andrea,

I agree with Sussane's opinion. A tax advisor and an attorney will be able to guide you best in this matter. Moreover, your lender shouldn't take such a long time to close your loan.

Did you even bother to read the form? If you didn't bother to follow the cautionary instructions regarding entries in 6 through 9, shame on you.

More to the point, the 4506-T you signed in November is a dead puppy. Well, assuming you weren't sloppy and dated your signature. Again, if you had read the form, you would have seen that the 4506-T is 'good' for only 120 days from the signature date for third parties.

Obviously there is something squirrelly about your income. Even though our government is doing everything humanly possible to increase cost and processing time for borrowers, an application in November without a decision pushes believability. The underwriter must determine the plausibility and reliability of your income BUT a new 4506-T should have been requested for the 2011 tax information. It's worth a letter to the IRS and I'd suggest the 'comment' address in the final paragraph of page 2 of the form. But if you failed to date your signature it likely will be 'no ticki, no laundry'.
