Can we be sued for backing out of mortage loan hours before closing?

We are scheduled to close today. We find out that we have to pay 2 months HOA fees up front at closing. We were unaware of that. Our realtor was like, "you should have known". This is our first purchase and we didn't know. Now we don't have enough money to close and haven't been able to find any one to loan us the money.
Can we be sued for backing out hours before closing?

As you haven't closed on your mortgage, you will be able to back out of the mortgage deal. However, you may lose the appraisal fees and other fees that you may have paid in this respect. The lender may not be ready to reimburse the fees back to you.
