Hello, I am a co-borrower on my parents mortgage on a house that was purchased in 1978 in New York. My parents have passed away and my brothers and I are dealing with Probate. My parents and I always believed that my name was on the deed since I was a co-borrower on the mortgage well it isn't. I have been living in the house for 34 years. Do I have full ownership? If not, do I have any recourse?
Hi Rdambrosio,
If your name is not mentioned on the property deed, then you don't have full ownership of the property. In order to get full ownership of the property, you will have to ask the other heirs to transfer the property to you.
Thanks

You can always get the full ownership of the property since you are one of the heir plus the fact that you have been living in that house for 34 years. You just need to be legally acknowledged by your local office by submitting the necessary requirements.
Cosigning a promissory note has nothing to do with ownership. Since you and your brothers are dealing with probate now, it ought to be a reasonable thing to do to change the ownership situation (based on anything that's stated on a will, of course).
Did your parents make any mention of their desire for succession in their will(s)?
