name on deed vs. name on mortgage

Posted on: 29th May, 2010 09:55 am
my husband's name is on the mortgage.
he recently died.
my name is only on the deed.
what is my responsibility to the mortgage?
thank you.
Welcome maryrose,

As your name is not on the mortgage docs, you are not responsible for the payments. However, if you do not make the payments on time, the lender will foreclose the property. It is better if you could contact your lender and refinance the loan in your name.

Hi Maryrose,

Adonis is absolutely correct. As your name is on the property and not on the mortgage, you are not responsible for the mortgage. However, as it is a joint property and your husband took the mortgage, the lender can foreclose the property. Consult with your lender and try to re-finance the mortgage in your name. That would be the best option open for you now.
