my husband and i are getting a divorce, he is letting me refinance our home in my name and i am in the process of doing so. i just found out he has a past due loan of about $7,000 through a company does mortgage loans. can he legally take a loan out against our home w/out my approval. we are both on the deed and the mortgage.

As per my knowledge if the property and the mortgage in joint name then your husband cannot take a loan against your home without your approval. Consult with a good attorney and send a letter to your husband he has taken a loan against your property.

If he is the sole owner of the property, then he can take out a loan on the property without your permission.
