i have a 1st mortgage and a heloc. when i attempt to refinance i am told they will only refinance my 1st, they will not include my heloc so that i might have just one loan that i can pay off. how can i get this accomplished? and what should i look out for?

You should contact other lenders and check out if they will help you in getting a mortgage which will let you combine the primary mortgage as well as the heloc into one.

If you have the required equity in your property, then the lender shouldn't create any problems in refinancing both the loans into one. You should follow what Sussane has said and contact other local lenders in order to qualify for a loan.

It will depend upon the lender as to whether or not he will give an HELOC on a non-owner occupied property. You should contact the lender and take his opinion regarding the same.
