Lein from closed business

Posted on: 29th Oct, 2013 10:05 am
I bought a business and leased the building from the same person. I eventually closed the business but was taken to court for selling some of the property and since my lawyer advised me not to fight it I didn't. She received a judgement against me for $8000. (a judge later determined that the property was owned by me). This was in 2007. I do not own any property. Will I be able to get a mortgage.
You probabaly cannot get a mortgage with an open judgment.

You will iether have to pay it or get it dismissed or vacated.

Welcome Irishlass,

I agree with John. Given your present situation and the judgment, you will not be able to get a mortgage unless you pay it off.

Yes, you will need the judgment removed. You might be able to get it settled (that is- you agree to pay only part of what's due) in order to get it released. If you find a good lender, he/she might be able and willing to help you negotiate a settlement. I just got the county to remove an old judgment for someone for about half of the 13k they were originally asking the borrower for.
