my sister is staying with me. she receives ssi disability income due to a brain injury. she has a defibrilator implanted in her heart, and takes several medications.
her name is on a mortgage with her ex boyfriend, and i can not apply for medicaid for her in ohio until her name is off that mortgage. it is affecting her eligibility for medicaid and subsidized housing. they split up in 2007 and she went to another state. she was on medicaid in that state - evidently they did not find her name on a mortgage or they didn't care.
the boyfriend says he can not refinance the house in his name only, and he won't sell. we can't wait that long anyhow. my sister needs medical like now! i don't know what to do, and i'm stressed! can anyone help?

If your sister's name is mentioned on the property deed of the concerned property, then she can file a partition lawsuit. The court will go through the whole situation and may order for the sale of the property. The sale proceeds will be used to pay off the mortgage dues first and then if there is an extra amount, it would be distributed among both of them. Thus, she would be able to get rid of the mortgage and then she can apply for Medicaid.
