Is it the sellers agents fault that our closing is delayed due to foreclosure deed issues? Shouldn't he have checked with all parties involved prior to agreeing ot the closing date?

It can be the fault of the seller's agent as well as the lender. You should speak to both of them and sort out the matter.

If the seller's agent knows it, they should disclose it. However, there are many cases that the sellers are not even aware that their house is getting foreclosed. It could be due to inproper notification from lenders etc.
