i am the primary person on my mortgage for my multi family home and the sencondary is my brother inlaw. he has moved away and separated from my sister. i am looking to get his name off the loan. i know the only way is to refinance, but does he need to sign any documents?

I don't think he needs to sign any documents. Nevertheless, you can ask your lender and he will let you know whether or not there are any such formalities required.

You should ask your lender about the matter whether or not he still has to sign it. But for me, since he went away and the fact that he is just your half brother, he may not be required to sign any documents.
Is he on Title also?
If he is on title, he would need to be quitclaimed from the property. Otherwise, you can just refinance him off the property if you can carry it on your own. Feel free to click on my profile, and contact us to discuss.
If he's on Title, he's going to be required to sign some of the final loan documents - that's the primary question you asked, and that's the answer.
