Adding my name to a deed

Posted on: 14th Sep, 2010 03:54 pm
My Mother died about a month ago. I will try and word this as simply as I can. About six years ago I had told my sister, in confidence that my husband might owe over fifty thousand dollars in back taxes to the government. She went to my Mother and had me taken off the will, without even consulting me. That said, now that my Mom has died, my sister wants to put me on the deed. My question is this, when my Mom died she had taken out a loan for about thirty-five thousand dollars to do some outside home improvements. She paid back perhaps ten thousand dollars. Now that my sister inherited the house, is she responsible for the loan? Thank you for taking the time to read this
Hi shebe,

As your sister's name is not mentioned on the mortgage documents, she is not liable for the loan payments. However, if the mortgage payments do not reach the lender on time, he will foreclose the property and sell it off to recover his balance amount. Thus, in my opinion, it will be better if your sister could assume the mortgage or refinance it and pay off the mortgage balance on time to save the property.

Thanks
