If a spouse is not on a mortgage, but is named on the deed are they liable for mortage debt?

If a spouse is not listed on the mortage loan but is listed on the deed of trust are they liable for any debt on the mortgage?

If the spouse's name is listed on the deed of trust, then he or she'll be equally liable for paying the mortgage dues. If the dues are not paid on time, then the lender can come after your spouse for the dues.

The Mortgage does not obligate anyone to pay anyhting. The Mortgage is identifying a lien on a property as collateral for a loan.

The Note obligates one to be responsible for paying.

Being only on a deed does not make anyone responsible for paying anything.


One must be on the Note to be responsible for paying and it appears she is not on the Note and, therefore, is not rsponsible for paying.
