Hi there… we’re home hunters. We have spent around 3 years looking for a home. Now when we got a home, the seller wants out. We had negotiated a price. Get it inspected. The property also has been appraised. But the seller has put down his foot. They offered to buy us out of the contract, but I'm not interested in money - I want the house. We have not found the features we're looking for, in any of the others houses we've looked at so far. This one is perfect. Are we stuck? We have an appointment with an attorney on Friday - but will a judge make someone leave their house?
You have taken the right step by contacting an attorney in this regard. The attorney will look into the whole matter and let you know whether or not you have a case to fight. If you have signed a contract, then the contract will stand as valid.
Gary, sorry to hear about your dilemma. The only way you can require the seller to go through with the contract is to have the judge order "specific performance". Your attorney will be able to tell you often that happens in your state, but most judges are reluctant to do that.
