I am the owner, sold property under land contract...they have missed all together 16 months in payments...I live in another State and can't afford to take them to court...Made my brother Power of attorney...Judge in Michigan will not let him go to court for me...How can I void the contract and evict them without a court hearing?
A land contract explicitly states that the title or deeds of the property will be transferred over to the buyer only after the complete payment of the agreed upon amount has been made to the seller. But until such time the seller may allow the buyer to occupy the property unless the buyer is in default. Normally there will be a modest initial payment after which the buyer will have to pay in monthly/ regular installments. The buyer may either continue on installments or make a lump sum balloon payment at the end. Once the entire amount including the interest has been paid the seller will transfer the legal title to the buyer.

If your land contract states that on non payment of dues, you can ask them to leave the property, then you can send them a legal notice to leave the property within a given time period. You can even speak to an attorney and take his opinion in this regard.
