Can a collection agency put a lien on my mobile home?

Posted on: 28th Sep, 2008 02:33 pm
My husband was injured 6 years ago and we returned his truck. He has no income, is disabled (no SSI) and I work, supporting him and 2 children. Collection agency is calling want repayment. Can they put a lien on our home (it is in my name only). We live in Calif. so I am responsible for his debts.
Hi hteri!

Welcome to Forums!

Yes, they can put a lien on it so that whenever you sell it they can get paid that way. But as far as I know, the mobile homes generally decrease in value with time. Moreover as I can understand from you question, the mortgage was on the vehicle and you have returned it. You must be having some documents stating that you have returned the vehicle. You can consult an attorney with those documents and take his/her opinion.

Feel free to ask if you have further queries.

As its a mobile home, the value of the property may decrease with time, so I don't think they will gain much by placing a lien on the property.
