Deed in Leiu of Foreclosure

Posted on: 27th Aug, 2010 07:48 pm
I was planning on doing a Deed in Leiu of foreclosure in NV. My house has a market value of $110000 and amount owed is $260000. Would I have to pay the IRS taxes per a 1099 for the difference of $150000 if I have lived in the home for over 4 years?
Hi desertfox!

Welcome to forums!

The deficient amount resulting from the sale of the property will be forgiven by the lender. The IRS will consider this forgiven dues as your income. But you won't have to pay taxes on the forgiven balance due to the Mortgage Debt Relief Act.

Feel free to ask if you've further queries.
