My teneant will not move and has not paid rent in 6 months and refuses to move.

I am a landlord in NJ and my tenant has not paid rent in 6 months. He had a stay due to bankruptcy filing which I went to court to have lifted. His BK was dismissed, he never made a rent payment or a Chapter 13 payment to the trustee. Will he be able to file again to create another stay? What advise do you have to regain my property? His case was dismissed in August, does he have to wait a period of time to refile? He has a full time job and according to his filing I am the only bill other than the BK lawyer. How long can he continue to re file and have stays keep me from regaining pocession of my property?
Call the sheriff. Post an eviction notice on the door.

Hi coan,

The tenant can again file bankruptcy in order to get an automatic stay on his creditor/lenders. As our guest poster has suggested, you can give an eviction notice to your tenant and ask them to leave the property due to the non-payment of dues.
