We worked out deal with 1st mortgage HSBC after 6 months for hardship program, paying that on time. Sent for hardship on 2nd mortgage HSBC several times they said never got it in the meantime they charged off 2nd . Our 2nd mortgage told us they found hardship letter but its too late they sent to collection they want all money up front . we cant pay and wanted hardship for reduced payment but it was too much. Can they now foreclose on these mortgages ? They are with same company. What can we do or what kind of lawyer to look for to help?
Hi ceramic04,
Welcome to mortgage fit,
If the matter is already forwarded to the collection agency then original lender will hardly answer your queries,so with the help of real estate attorney you may file ch.13 bankruptcy so that you will be able to get the reduced payment plan where you would be in position to keep the house without getting it foreclosed.....
For further information on the ch.13 bankruptcy you may visit below mentioned link....http://www.mortgagefit.com/bankruptcy/chapter13.html
Keep in mind that filing for ch.13 BK may lower your credit score considerably.
Feel free to ask any further query if you have....
