Right to partition forms in nyc

Posted on: 16th Oct, 2009 12:56 am
Asked a similar question before, but prhaps was not clear.
Just need to know where to get the forms

Thanks

Hello,

I am a joint owner of properties deeded to myself and 4 siblings in NYS (mortgage free except for one property with a small mortgage). Some of my sibs, the majority, wish to be bought out while the other two are not cooperating and communication has broken down.

I believe once the other two see the wisdom of dealing with this on our own as opposed to the cost of a Right to Partition or Right to Kind it would open up communication.

My question to you is where can I get a form to Petition for a Partition of community property. I would like to file this on my own initially and it is my understanding it can be stopped if parties reach an agreement . I believe that once my siblings see we are serious about this we will come to some kind of agreement.

If possible I would like to start the filing of this petition without a lawyer as we are strapped for cash.

Of course, if it comes to it a lawyer will be necessary, but would like to give it a shot to file on my own to begin with and get the ball rolling.

Any clues on where to get a form for NYS.. I have only found one on line for Louisiana. No help to me there.

Thank you in Advance.

Joan
I don't think a sample partition lawsuit form is available online. You will have to contact an attorney in order to file a partition lawsuit. He will guide you with the required forms and other details.
