My sister's husband recently died and resides in VA. Can she homestead her home after the death of her husband or should she have done so before?

In the Homestead act of 1879, under article 2181, the wife of the deceased husband gets the power to manage, control and dispose of the community property. The social structure of Virgina too changed with this act. Still I believe that it depends on the will too.
