homestead after death

My sister's husband recently died and resides in VA. Can she homestead her home after the death of her husband or should she have done so before?

What help can she receive to assist in keeping her from losing the home?
homestead is for taxes

Having a will or trust will determine who the house will go to
In some states the spouse automatically owns half of the assets as soon as they get married.

In the Homestead act of 1879, under article 2181, the wife of the deceased husband gets the power to manage, control and dispose of the community property. The social structure of Virgina too changed with this act. Still I believe that it depends on the will too.
