"courtesy/dower rights" in Ohio

Posted on: 07th Dec, 2010 06:31 am
I signed my rights to our Ohio property over to my wife 8 years ago due to health and because her inheritance had paid everything on that property to date. She didnt record the deed immediately. But did record it. We still owned property in Maryland, and I had a share in some commercial property back there.
Some time after she recorded it I was sued in that state over a business matter that she was not involved in and had not signed for. The judgement was against me and my business partner. The claimant is a lawyer in that state that collected over 78,000 from me and less than 10,000 from my business partner, majority of work dealt with my partner but we had both signed the retainer. I paid until I couldnt anymore. That same attorney is the one who advised me to sign the property over to her and arranged everything with an Ohio attorney. Now Md. attorney is going after partners Md. house for the small balance and 3 times that amount in interest that was awarded to him. I no longer own any property at all. Can they go after my wife' property? Two years ago she did a reverse mortgage and they had me sign under Ohio's dower rights law, but I believe I signed a Quit Claim 8 years ago.
Hi jimrowell,

If the debt was taken in your name and your partner's name, then the creditors won't be able to come after your wife's property. However, if you own the property jointly with her, then the creditor can go after the property.

Thanks

ive been researching dower rights on this site and seem to get conflicting info...in one instance they can be signed away and then i read no matter what, the rights remain...heres my situation:

my wife and i bought a house in 2000, while married, in her name...i was just on the deed. ive since filed a quit claim deed so im off the deed.
i want to buy a new home in my name only...if we cant sell or rent the other home it will be foreclosed on if we cant afford both payments...
since im off the first home can the bank come after me or my property?
would my wife have dower rights to the new property?
