I am in Mointgomery County,Ohio. My home is being foreclosed on. The sherriffs sale is scheduled for Friday the 12th of Feb. I was told that a sherriff will be serving me with papers. How long do I have to vacate the property? My husband left,I have Multiple Sclerosis and a nine year old son. I am concerned about being able to clear my house out quickly.
First of all sorry for your misfortune. I am also in OH. Cleveland area. Through my experiances, you should have at least a month after the sheriffs sale to be out of the property.
Because, the home will transfer back to the bank at the sheriffs sale. And it will be a week or two before the bank will send a rep out to the house to board it up and change the locks. And if you are still in the house at that time, you are considered squatters. And being a squatter you have rights too. The bank will have to go through the "legal motions" to kick you out at that time.
So that should buy you enough time to make arrangements to leave the home.
