is there any information if the owner is at fault? I entered into a contract on a yellow sheet of legal paper (owner wrote). He said his attorney would write out a contract for us to sign. (January) On this yellow sheet of paper he wrote he would have the contract in 45 days. That did not happen. I gave he several reminders during the course with my payments. ($5000 down payment, $100,000 loan amt, monthly pymnts $833.69, 10% interest, addtl $2500.00 at tax time (not principal), if payments were made on time he would take off $1000 at the end of year, for 30 years agreement). I wanted a contract so I said I would not payment Junes payment until I get the contract. He found someone that was not his attorney to write the contract. She read each section of the owner finance contract and explained everything to both of us. We both signed -I made the payment and they both left the home I was buying.
In June the owner was asked to produce the contract to the mortgage on the home and any information such as taxes, home owners insurance anything he had to make sure everything was current. He (owner) never complied.
(July)I received a letter stating the home was going into forclosure. At this time I had paid close to $15,000 and made some improvements (there were no door knobs on the doors, I had to fix the plumbing and someother things- which I have saved my receipts). I called the person that wrote the contract, she called the owner. The owner agreed to have a property manager. So she helped with the foreclosure by getting all of us in the same room at the Tax property office to call the mortgage company. They said that they needed some payment to release the foreclosure. I paid $733.69 that day and the owner agreed to pay $200 - he only paid $180.00 2 weeks later. Then begged us to give him gas money.
Next we found out he was not able to sell the home until the 2nd mortgage was paid off. they said the contract could only be a lease with the option. I did not want this.
Then we found out he did not have homeowner insurance on the property. I had to pay for that.
Then we went into the Tax office - the taxes were several years (5) past due. I am paying for them also.
Then we filed a contract for deed - only to find out there was a utility lein - So I had that released.
The lady that wrote the contract has been so helpful in helping me get this stuff back in order. I am $550 shy of having everything current and the owner no longer wants her to be involved and wants me to send the money to him. Then hired an attorney, in stead of following the contract. I have spent close to $20,000 everything is current with the exception of the Taxes. I should have it current in the next couple of month so I can start paying the 2010 by January. I have worked very hard on keeping this house. (financially and physically)
I am an unsophistic investor when I bought the home. I need help, since he has an attorney calling me. I feel like I have over paid for the home. The sqft on the home is 1162. I am paying $100,000 @ 10% for 30 years addtl $2500 not towards the principal each tax year.
On the Taxes I received for 2010 I noticed a storage building as an improvement - the owner had it removed from the property and charged me $600.(I had to pay it towards the foreclosure). He said that is why the house payment was not paid. How do I get this building removed from the taxes.
I need help... Our contract states we are to have a property manager and It states we are to go to mediation for disagreements. then if not settled hire an attorney.
Concerns:
This owner has sit in front of my home for hours never getting out of the truck. My husband will approach the truck and he will drive off. We would call he and ask if he could not do that, his reply everytime is "it my God given right to sit or drive anywhere I please. Noone can tell me where to drive. This owner has called several times (20+) on the phone during the night and early morning and hung up. When we called him back he would say he did not call. The owner would come over knock on one door walk/run around the home and press his face into the glass of the back door while pounding on the door.
The owner has entered the home went through my personal belongings, go through the cabinets while I was not home. Then call regarding some tool that he claimed was his.
The property manager sent him a Notice to Cure or Quit twice (1st for 14 days 2nd for additional 15 days). Frankly, I am afraid for me and my children so we stay at my husband's job until he is finished so we can go home.
I like the home, have invested a lot of money and time into the home and feel I am the victim. Is there anything a buyer has rights to. I am not able (financially) to hire an attorney. He has and I need help as he has let the property manager go.

You have mentioned that you won't be able to afford an attorney. But it would be the best option to hire an attorney immediately and take legal actions against him. Unless you take legal actions against him, I don't think he will stop harassing you and your family.
