If divorse couple have a 2nd in both their names, and the 2nd was ordered to be paid by ex-wife. If she has not attempted to take the ex-husbands name off the 2nd and files bankruptcy, is the ex-husband now have to pay for the 2nd also even though it was court ordered? Can you file bankruptcy on a 2nd loan without both parties approving?

If the ex-husband's name is still on the loan, then there is a high chance that the lender will come after the ex-husband to recover the debts. You can file bankruptcy and include a debt if you're liable for its payments.

But even though she was awarded this debt in the divorse decree? Also, Can you file bankruptcy on a 2nd loan without both parties approving?

We need to get a ex off the mortgage but his credit is not good, esp if I will have to file bankruptcy also. Any suggestions on what I can do?
