my husband and his sister co-sign a mortgate.
his sister wanted to remove his name from the property by refinance.
she ask my husband to sign the form from the bank
title: letter from seller
seller name: my husband name
i have 3 questions
is that how the refinance process to remove my husband name?
how come the form is not from the co-signer, but from the seller?
what is the best to deal with this refinance to avoid the problem in the future?

That doesn't seem correct. It's a basic refinance. He should write an LOE explaining that he's removing himself from the Title and mortgage. That should be it.
in order to remove him from the home he would have to sign a quit claim deed. if they want to remove him from the loan all she has to do is refinance the home and do the new loan in her name only.
yes, indeed...he quit claims his interest in the property to his sister and concurrently, she works in tandem with the lender to acquire a new loan that eliminates his responsibility for the old loan, which is paid in full at closing with the new loan.
Glad we are on the same page George. A previous poster mentioned just right an LOE. That won't be enough especially in this day and age of mortgage underwriting. Everything has to be done according to guidelines.

I apologize for the quick response Bradley. To remove someone from a mortgage, she would have to refinance in her name only. The Underwriter will probably request an LOE from the person that was previously on the loan with her explaining the removal. To remove yourself from Title, he would have to sign a quit claim deed. I apologize!!!
