my home has been condemed due to flooding in basement, high levels of lead base paint and roof shot. Insurance will not cover the flooding. I still owe 22000 on it and cannot live in it. I am living in the yard in a camper. I got a good job about 4 months ago. I am married but the house is only in my name. I would like to keep the property and move mobile home on to live in. I cannot tear the house down untill its paid off. North dakota winters are very cold. Can just I file Bankrupcy and not my husband and still keep the property? Will it affect my husbands credit?
Hi ekahnell,
If you file bankruptcy alone, then it won't affect your husband's credit. You may file bankruptcy in order to get rid of the debts. But this won't help you in saving the home. If you want to save the home, you will have to reaffirm the mortgage in your bankruptcy filing which will make you liable for the mortgage payments once again.
Thanks

I don't understand this part ... condemned homes are usually torn down due to health and safety concerns.

You can make a debt agreement to your lender however, you will need a good advice on an expert. Try to consult with an expert and ask for assistance on your loan problems.
Regarding the above...please ensure that the "expert" with whom you consult isn't someone who refers you to an expert of a different stripe, or someone whose expertise lies in an entirely different framework. Frankly, if you knew an expert in the field that you're describing as your issue, I think you might already have solved your problems.
