There was lien placed on my property in 1994, the result of lawsuit. I filed bankruptcy before lien being placed and the lawsuit was dismissed. I tried to sell property recently but found that the lien is still there. How do I remove it and why is it still there?
If the bankruptcy has discharged the lien, then you should provide a copy of the order of discharge to the title insurance company which is likely to offer coverage for the new owner. The company will remove your lien as encumbrance on the title report.
If the bankruptcy discharge order does not satisfy the title company or the buyer, you may have to talk to your bankruptcy attorney. He may be able to find some way out.
