I signed as a cosigner for my friend's mortgage. Now he has fallen behind on payments. So do I have the rights to take over the property?

You can take over the property if you have ownership rights on it. For this, you can file a partition lawsuit to get the property divided between two owners.

If both of you are the owners of the property, then one of you can get the title while the other can get an equity interest. This equity interest has a value equal to the market value of the ownership each has in the property. The share of interest owned by the person should be free from liens. In this way, you can take care of the monthly payments without having to lose the property.

cosigner means that he should be on the title or not. What is the difference between a cosigner or a garantor.

If you were put on title which you may have been since co-signing usuallly requires this, you would have the right but would you want to since this is your friend?

I guess you need to talk to an attorney and then file the lawsuit.
