my home had orig. been set for sale on 12/3/08 ...but i contacted the lender & had provided req, info for a modification...i did not haer anything until mid 2/09 ...i rec. a modification packet req that i contact them by 3/13/09 ...but i also a few days later rec. a denial ??...i had tried for several weeks to contact the rep that was handling our acct but was always out throught o v/m ...i finally spoke to her 3/16/09 which i was on the phone for 45 min ...i would not be able to accept the terms that they had sent in the packet but my in-laws had been pre-qualified & i had hoped that we could do a short sale ...to my surprise rep advised that my home had been sold 3/10/09... i had not rec. anything reg. my home being placed back up for aution & had thought that they were trying to resolve this before home was auctioned....so ny question is ....should they have notified me once they had placed the home for aution the 2nd time ?? as we could have did a short sale ..

suzi did you have legal representation or were you trying to do this on your own? if the former, you may have a chance. have you spoken with the court? if you didn't have a lawyer, do you have one now - or, at least, an advocate?
