how do i get my name off the title of a house me and my husband share ImmEDIately!!!

Posted on: 05th May, 2009 11:48 am
My husband and i are seperated and he hasn't been paying his homeowners fees. My name is still on the house. They are suing him for the money now and are going to go in to my account and take the money for it because he doesn't have a bank account. I know this cuz they have already done this once last october. I need to get my name off the house this week!!! how i do this??
I am assuming that he or you are no longer makign any payments on the house correct?

What's the situation with the loan?

Both of are responsible for payment as logn as yoru name is on the property.

Have you spken to the HOA and explained them this situation? Are you staying at that place?

He is making payments on the house. He just hasn't paid the HOA fees for a year. My name is not on the mortgage, it is just on the deed to the house. I have spoken to the HOA and they dont' seem to care. They say My name is on the house so i am responsible.

Open a new bank account and move all your money there.

If they have yoru credit card cancel your credit card. They cannot just pull money from your account unless they have all this information.

Also talk to an attorney and see what legal action you can take against the HOA and your husband.

Hi bern,

If the property is free and clear, then you can ask your common law mate to use a warranty deed and add your name to the property. If there is a lien on the property, then you should ask that person to use a quitclaim deed and add your name to the property deed. This will make you one of the owners of the property.

Thanks
