What is the best path for a house I know will not sell? Forclosure?

My husband and I have planned to move to a new state for his job transfer. Our house was for sale. We have learned that the septic system is failing in our 1 year old house along with 10 other homes on our street. With this huge problem we are not able to sell our house until the septic is fixed. It could take 1-3 years and there is no guarantee it will sell due to these current problems. I will not go into debt by paying a mortgage as well as rent. What is the best path for me given the current situation. I do not have money to sue the builder of my home. I will eventually refuse to pay my mortgage.
Is this a new house?

Why do not you all get together with simialr problem and approach the builder. If you go individually they may not respond.

Contact your local news paper and also TV stattion and explain your plan. I woudl take this approach if the builder does nto respond or deny to repair.

Realgeni, I think this is the new house because he said " We have learned that the septic system is failing in our 1 year old house ".

There is big problem of septic system so i would like to advice you that give your house on rent to another person while you living in other state that better option to avoid big loss. You can pay your mortgages installments by your house's rent & when this problem fixed you can sell your house easily.
In my opinion this is the better.

This is not bad idea to keep home on rent while problem going to be solved.

If you are goign to rent and let the problem sit, then when the problem happnes the builder may not help or you may not have time and money to fix the problem.

Fix it when it is small, do not waiti for it to become too big.
