I have been living in a Florida leased condo for the past 20 months (separated and divorced for a year). In the divorce papers me ex-husband was ordered to maintain the morgage on the marital home as part of the "bridge the-gap alimony" and to take possession if he wished. Well, he's continued to live in the house and I have been living in a one-bedroom condo with primary custody of two small children. I have worked for the past two years as a teacher, obtaining my professional certification on the side in graduate school. I just signed a contract for the next school year and really need a place for my children and myself to call home for the next 15+ years BUT I've been told its pointless since my name is still on the morgage of the marrital home. I feel powerless. Does anyone know of any options? "He" claims he is unable to re-finance and everytime he's late with a payment it shows up on my credit report. My attorney said if the house forecloses then I could sue for lost of profit. The house is $159,000. appraised with a little less in debt on it.
Karin, get your attorney working on this right away. Seems like you should move back in the house and make the payments while he move out into a one bedroom condo.
