i was married in 2008. my husband owned a home with his exwife until their divorce in 2005 but his name remained on the deed until 2007 when she refinanced her home. i am buying a home next month, his name will not be on the mortgage loan. but his name will be on the title. will i, the buyer, still be eligible for the tax credit if his name is on the title? i have never owned a home before.
should i leave him off the title? i live in a community property state, so i thought he has to be on the deed.

You will most likely need to keep his name off of the deed to colelct the first time home buyer credit. You could probably add his name to the deed later. Regarding the "community property" comment, please check with an estate attorney in your area.
