16 mo. ago my mother was unable to keep up the mo mortgage payment on her house, due to the death of my brother, of which whom my mom cared for for 35 yrs. my then boyfriend offered to step in and assume full responsibility of the house, mortgage, repairs, leasing ect. the quit deed to the house is in both mine and his name. he has now decided that he no longer wants to assume responsibility of the house, it is now in default and will fore close at the end of this mo. ( aug ) there are tenents living in the house from which he has been collecting rent from for the past 3 mo. i have resources to pay what is in default, but he will not cooperate unless he gets back some of the monies he has put out. what can i do to protect my interest in the house. please help
better consult an attorney. i think first you get rid of him & get property in your name.

inform it to your lender. have you received any letter from your bank regarding foreclosure?

Yes we have recieved a notice, the thing that I'm confused about is the loan is in my moms name only, the deed is in mine and my ex name. my moms credit is already being affected by his actions. first because of late payments every month and now not making a payment at all for what now is going on 4 mo. isn't there something I can do being that I am of equal partnership on the deed?

Alina

Even though your name is on the deed, your mother is still responsible for the loan. You need to refiance the loan in yoru name to get full control

Good luck and feel free to ask
