BOth the husband and wife are on the title and the mortgage, the wife passes away. Now the mortgage company says that there should be an estate opened, even though the husband is on the title and mortgage. Can't he just provide the mortgage company with the death certificate for his wife and then the mortgage would just stay in his name.
he may need to refinance just in his name, if the lender took in to account both of their income
