my ex-husband and i are both on the deed of a property but the mortgage is in his name. In our divorce settlement I am supposed to quick claim the deed when he has fufilled his obligation of monetary payments wich he has defaulted on for 2 years now .he has allowed the property to go into forclosure and the property is empty. is there anyway for me to take control of the property/ mortgage.
Only way is if the bank can sell it to you with out completign the foreclosure
I do nto think there is specific process, but you cna call the bank and see if you cna refiance the loan in yoru name, since your name is still on the property
But make sure in thsi process your EX quit claims the property to yoru name or his name will still remain on the property, but not on the loan
