Judgement in Title Search

Posted on: 14th Nov, 2009 02:00 pm
I am a first time homebuyer (almost) scheduled to close on a house in a little over a week with an FHA loan. My credit came up good. I received results in the mail from the title search, and what appears are two judgements against the seller (who has an extremely common name), and one judgement against what appears to be an extremely butchered variation on my name and an address I have never lived at. I would never have used that name and have never lied about my address in my life. What can/will happen next?

Your Loan Officer should have told you to write a Letter of Explanation to the Underwriter, explaining what you've said. It'll be provided to the Credit Bureau's so they can remove the error from your Reports.

The Seller will do the same thing for the Judgements that are in error, and will pay the Judgements that are real with the proceeds from their equity when the loan funds.
