my mother lived with me when my home foreclosed 6 years ago. (tried to sell it - unsuccessful). she purchased a home for all of us, and did a quitclaim to me right after closing. there is a 30 year loan on the property, which i have been paying the entire time and doing all updates and repairs. she passed away a few months ago and i have been paying the mortgage and haven't informed the lender. do i have to tell them and can they force me to refinance? i am sure my payments would increase because of my credit and i would not be able to afford it.

Yes you have inform to your lender about Your mothers death. He will ask you for refinance mortgage on you, but as you said your credit score is not good then you have to repair your credit score to get refinaced in lowest mortgage rates & that will be better.

what happens if I can't refinance beacuse of my credit?

Currently you can keep paying to lender but please inform to your lender about your mothers death & you have negotiate with lender about that & I hope he will agree to do that. Try to improve your credit score earlier so can refinance mortgage on your name.
