Interspousal Transfer Deed

Posted on: 12th Dec, 2010 10:56 am
My husband and reside in California, he purchased the home we live in and had me sign an inter spousal transfer deed. I understand that I legally have no rights to the property should we get a divorce, the loan and the title are under his name but I help him pay half the mortgage am I entitle to ask for any kind of reimbursement if we get divorced?
Welcome senbonita,

Though you help your husband in paying half of the mortgage, you won't be able to claim anything from the property at the time of divorce as you've signed the inter-spousal transfer deed.

Any real estate document can be complicated, including documents associated to the deed, which conveys ownership, or a deed of trust, which conveys financial responsibility. When a marriage dissolves, considerations are focused on interspousal transfer deeds or quitclaim deeds based on statutes of limitations.
