just want to take a deed to notary ,so that he can sell to me for a dollar and not be contested if he dies

If there is no lien on the property, then your brother can use a warranty deed in order to transfer the property to you. Your brother can get the warranty deed drafted from an attorney. Once the deed is signed, it needs to be recorded at the county recorder's office. The deed will be considered as invalid if you try to record it after your brother's death.
