co-owner moved out

me and my mother bought a house together as invesment, both names are on the note we split everything 50/50 after she attacked my fiance she moved out but still has her property here and shes refusing paying her part of mortgage. can i serve her papers and take her to court for non payment?also am i allowed to change the locks? thank you for your time and consideration.

Your attorney will be the best person to let you know whether or not you can take your mother to the court for the non-payment of the dues. You can ask your mother to transfer the property to you so that you become the sole owner of the property. Then, you can refinance the mortgage in your name so that you become solely liable for the mortgage. This will make you the sole owner of the property as well as the mortgage.
