My friend received a lis pendes, and all the other documents that follow, the bank agreed to a loan modification she started sending the payments and the bank returned her checks uncashed and proceede with the foreclosure, they went to court and judge talked via telephone with attorney for Suntrust Bank (Lender) Judge gave the attorney an order to contact the defendants he agreed to do this, 90 + days they did not hear anything from attorney/ or bank. So they file a motion to dissmiss because of banks default to contact them they still have not heard anything so they want to file a request for final judgement against the bank and have the case closed. Pls advise how to prepare this request or if there is a form letter for this final judgement against Suntrust Bank. Thanks

It will be better if your friend could contact an attorney and take his help in filing the request for final judgment. The attorney will be the best person to help you in this regard.

I'm a bit incredulous that they didn't have legal representation to begin with; it would have been a wise move from the get-go.
Inasmuch as they've gone through all this court ordeal without legal representation and have had success with the court's rulings, why not simply contact the court itself and ask about how to seek this final judgment ruling? It would seem their lack of legal representation thus far is based on something other than chance.
