The marital home of 18 years is deeded in both our names. The refinanced mortgage is in his name only. We have not been paid in over 3 years - including taxes, the bank has paid taxes though - The home is shortly going to be foreclosed on. Where does this leave me? I live in the home - he does not and has not for 5 years.

As your name is mentioned in the property deed, you will be considered as one of the owners of the property. You may even claim your share from that property. However, as the mortgage is not in your name, then you won't be liable for the mortgage payments and the lender cannot come after you to recover the debts after the foreclosure.
