I live in Illinois and me my wife and her grandfathers names are on the deed. The grandfather passed away and I went to court house with death certificate to get his name off the deed. They told me to get a quitclaim deed and to use the death certificate as part of the grantor signature. My notary will not notorise it because she does not think this is correct. Can someone help me with the correct process
Welcome chriskane,
As far as I know, in order to remove the grandfather's name from the property deed, your wife will have to file an affidavit of heirship at the county recorder's office. I will suggest you to contact a real estate attorney and take his help in this regard.
